EPA Burial At Sea Regulations


According to regulations (40CFR 229.1) based on the Marine Protection, Research and Sanctuary Act of 1972, human remains transported from U.S. ports or on U.S. vessels or aircraft may be buried at sea under specified conditions. These include cremated as well as non-cremated remains. Requirements for burying remains at sea are listed below.  Please note the requirement that the (EPA) be notified within 30 days after burial.


  • Preparation for burial. Human remains shall be prepared for burial at sea and buried in accordance with accepted practices and requirements as may be deemed appropriate and desirable by the U.S. Navy, U.S. Coast Guard, or civil authority charged with the responsibility for making such arrangements. For example, local health departments may require burial or cremation permits.
  • Disposal location and measures.  Cremated remains shall be buried in or on ocean waters without regard to the depth limitations provided that such burial take place at least 3 nautical miles from land.
  • Decomposable flowers and wreaths. Flowers and wreaths consisting of materials that are readily decomposable in the marine environment may be placed at the burial site.
  • Notice to EPA within 30 days. All burials conducted shall be reported within 30 days to the EPA Region in writing.

Attended Service for Burial / Ashes Scattering at Sea


For those families wishing to attend the voyage, Metamorphosis Boat Charters provides scattering service tailored to the family's preference.  Cost for this service is $450 with estimated time of 2 hours.  The Metamorphosis is limited to carry up to 6 passengers, however we can assist with logistics for a larger group on an alternative US Coast Guard inspected vessel.


You may choose to have the Captain conduct the service or provide your own --- we will include seasonal flower for the scattering and slowly circle the site before returning to harbor.  On the return, the Captain with provide a shoreline pass of Atlantic City and share much of the City's history. We strive to provide a very positive experience of closure for the family and an everlasting fond memory of the service.  Afterwards, we will file paperwork with the EPA on your behalf and provide a copy and a Certificate of Scattering with the date and location of scattering.


Unattended Scattering at Sea


Often families cannot venture to sea or attend a sea scattering service. Our captain brings the cremated remains on an ocean voyage for you.  A dignified sea scattering or burial at sea is performed and documented, with that documentation provided to you.  This is our most affordable option, with price at $250.  We will also provide flowers and document with digital photography if requested at no additional cost. Additionally, You may Skype or FaceTime at the time of scattering to share in the experience.

Ashes Scattering at Sea

Captain Stewart Rosen has been navigating the Atlantic City and New Jersey waterways for over 40 years.  As a U.S. Coast Guard Licensed Captain for over 25 years, safety and customer service are most paramount to each voyage.   Memorial services including burials at sea were recognized as a much needed service in which Captain Rosen has specialized in supporting for over 20 years.  He will do his best to make sure that scattering services are handled with the upmost dignity and that each memorial is tailored to the individual family preferences. 

Historically, burials at sea services has either been reserved for the military during times of conflict, or a recognized ritual within many cultures.  In current times, in addition to cultural desires, ashes scattering at sea has gained popularity either due to decedents preference and ties to a location or love of the sea.  Whatever the reason for this preference, an ashes scattering ceremony is a professional and memorable closure and celebration of life.
